The UST section has approved the use of the Stand-Alone-System from Tank Tech, Inc. in North Carolina on a case-by-case basis. The approval letter listing the steps that need to be completed to submit an approval request can be found at the following link.

Effective February 1, 2016 releases from Commercial USTs, that have an Intermediate Risk, Rank and Abatement score of 110 and above are required to proceed with necessary risk re-evaluation procedures, utilizing the tasks proscribed in the associated task list. Responsible parties will be notified in writing of their requirement to proceed with all necessary assessment and corrective actions. (Risk, Rank and Abatement score of I-110 and above)

On September 18, 2015, Governor McCrory signed Session Law (SL) 2015-241. This law alters the statutory and regulatory authority used by the Division of Waste Management's UST Section in managing leaking noncommercial UST sites, as well as in the reimbursement of necessary costs to address those releases.

The UST Section is compiling a list of companies that offer services to UST owners and operators. The list is voluntary and will be provided as a courtesy to UST owners and operators. The UST Section does not make any recommendations of the qualifications or consider this an approved list of companies. If you would like your company listed with the services you offer, then complete the UST Service Provider Listing form and submit to the UST Section. The first list of companies will be posted to our website September 30th and then updated once a month thereafter.

Proposed rules: Section 15A NCAC 02L .0500; Rules 15A NCAC 02L .0501through .0515 - Risk-Based Assessment and Corrective Action for Non-UST Petroleum Releases. A public hearing for the proposed rules is scheduled for Wednesday, August 26, 2015, at 2 p.m. at the DENR Building, 217 West Jones Street, Raleigh, NC, Room 1210. Oral comments may be presented at the public hearing; written comments may be submitted to the attention of Linda L. Smith, NCDENR/UST Section, 1637 Mail Service Center, Raleigh, NC 27699-1637, from August 3, 2015 until October 2, 2015.
Procedure for Subjecting a Proposed Rule to Legislative Review: If an objection is not resolved prior to the adoption of the rule, a person may also submit written objections to the Rules Review Commission. If the Rules Review Commission receives written and signed objections in accordance with G.S. 150B-21.3(b2) from 10 or more persons clearly requesting review by the legislature and the Rules Review Commission approves the rule, the rule will become effective as provided in G.S. 150B-21.3(b1). The Commission will receive written objections until 5:00 p.m. on the day following the day the Commission approves the rule. The Commission will receive those objections by mail, delivery service, hand delivery, or facsimile transmission. If you have any further questions concerning the submission of objections to the Commission, please call a Commission staff attorney at 919-431-3000.

Updated Trust Fund Claim Package Forms (Secondary Form C.1 and C.3) have been made available on the UST Section Reasonable Rate Document portal under the 2010 Reasonable Rate Document header ( http://portal.ncdenr.org/web/wm/ust/rrd ) which incorporate the efforts associated with risk-based site closure directly into the applicable Trust Fund Limited Site Assessment (LSA) tasks (Tasks 2.600 & 2.610) if performed concurrent with the completion of the risk classification. Electronic Document Submittal for the UST Section Corrective Action Branch (see memo)
The UST Section is transitioning to electronic data management in order to enhance customer service,
reduce paper consumption, and decrease requirements for file space. Starting on March 1, 2014, all
reports (including, but not limited to, 20-Day Reports, Initial Abatement Action Reports, LSA Reports,
CSA Reports, CAPs, NTCPs, monitoring reports, etc.) required by the UST Section should be
submitted according to the instructions in the memo found in the above link.
